13 Robert Ludgater Be it Remembred that upon the Eleventh day of April in the Eighth year of the Reigne of George of Greate Brittain & France and Ireland King xv Anno q3 (?) domini 1722 I Robert Ludgater of little Coggeshall in the County of Essex Felmonger being of sound mind and disposing memory thanks be given to God for the same do make and ordain this my last will and Testament in manner and form Following (that is to say) In primis Whereas Mary my now loving Wife did bring to me upon our Marriage the full sum of two hundred and Fifty pounds of Lawfull money of Great Brittaine and it was then fully agreed between us that all the said moneys in case the said Mary should happen to survive me should be and remain to the said Mary to and for her own proper use and behoof and Whereas the sume of forty pounds part of the said sume of two hundred and Fifty pounds the said Mary hath put out at Interest to Barnaby Stevenson of Oakly Magna in the said County of Essex Butcher upon his Bond or Obligation taken in the proper name of the said Mary and now in her own Custody and also the sume of twenty and five pounds other part of the said sume of two hundred and Fifty pounds the said Mary hath put out at Interest together with the sume of twenty and five pounds to be paid to Stephen Milsop to Ame Furly of Colchester in the said County of Essex widow of John Furly deceased upon her Bond or Obligation taken in the proper name of the said Mary and now in her own Custody now in pursuance of our said Marriage agreement I do hereby give and bequeath to the said Mary my Wife to her own proper use and behoofe the said sume of Forty pounds and the said First mentioned sume of twenty and five pounds secured by the said severuall Bonds or Obligations as aforesaid and my will is that the said Mary shall immediately from and after my decease have and Receive the said sum of forty pounds and the said First mentioned sum of twenty and five pounds to and for her own proper use accordingly Item whereas I have lately by and with the direction and appointment of the said Mary my Wife put out at Interest the sume of one hundred and five pounds other part of her said sum of two hundred and Fifty pounds together with the sume of fifteen pounds of my own proper moneys (both together making the sume of one hundred and twenty pounds (unto Thomas Selfe the younger of Stisted in the County of Essex Carpenter upon a certain Mortgage or Security made to me in my own name by the said Thomas Selfe and andrew Fuller ?ont and bearing date on or about the fourth day of February in the year of our Lord one Thousand seven hundred and twenty and Whereas I did lately by and with the direction and appointment of the said Mary my Wife put out at Interest to Joseph Harvey of Oakly Magna aforesaid Cordwainer upon his bond or Obligation made lone in my own name and bearing date on or about the twentieth day of Aprill now last past the sume of Eighty five pounds part of my said Wifes monys of which said sume of Eighty five pounds the sume of sixty five pounds as is suite paid into [sic] my said Wife and is so Indorsed upon the said Bond that there is now remaining due on the said Bond of the said Joseph Harvey for principall moneys the sume of twenty pounds only which said sume of twenty pounds is other part of the above mentioned sume of two hundred and Fifty pounds my said Wifes money (and Whereas said lately by and with the direction and oppointment of the said Mary my Wife put out at Interest to John Evens of Great Coggeshall aforesaid Malster upon his Bond or Obligation made to me in my own name and bearing date on or about the sixteenth day of August now last past the sume of twenty pounds other part of the said sum of two hundred and Fifty pounds my said Wifes monys and Whereas my said Wife hath now in her own Custody and possession the sume of forty pounds being the Residue and Remainder of her said sume of two hundred and Fifty pounds now in pursuance of our said Marriage agreement I do hereby give and bequeath to the said Mary my Wife to her own proper use and behoof the said sume of one hundred and five pounds due upon the said Mortgage of the said Thomas Selfe and the said sume of twenty pounds remaining due on the said Bond of the said Joseph Harvey and the said sume of twenty pounds due upon the said Bond of the said John Evens and also the said sume of Forty pounds now in the Custody or possession of the said Mary my Wife and I will that the said Mary my Wife shall Immediately from and after my decease have receive retain and take the said seuerall sums to and for her own proper use accordingly and in case the said sume of Forty punds now in the Custody of my said Wife shall be lent or put out at Interest before my death or if any of the said other sumes of my said Wifes money shall be paid in before my death and shall be againe lent out or shall not be lent out in every or any of the said Cases I give and bequeath all and every the said moneys to the said Mary my Wife to her own proper use it being my full will and true intent and meaning that my said wife shall have and Enjoy immediately from and after my decease the said sume of two hundred and Fifty pounds to her own proper use forever Item I further give and devise unto the said Mary my loving Wife all that part which was late in the Tenure or Occupation of Robert Cullip or his assignes of and in my Copyhold Messuage or Tenement and yard thereunto belonging wherein I now dwell stituate [sic] lying and being in Little Coggeshall aforesaid To have and to hold all the said part to the said Mary my Wife for and during the term of her naturall life if she so long continue my Widow the said Mary keeping the said part in good and Tenentable Repaires and from and after the death or Marriage of the said Mary which shall first happen I give and devise the said part of the said premisses unto my son Thomas Ludgater his Heirs and assignes absolutely and for ever Item I give and devise unto my said son Thomas Ludgater his Heirs and assignes absolutely and [Item I give and devise unto my said son Thomas Ludgater his Heires and assignes absolutely and for ever] for ever all the other part and Residue of my said Messuage or Tenement with the yards and appurtenances to the same belonging and my will is that my said son Thomas Ludgater and his Heirs shall and may enter into and upon the said part and Residue within one week next after my decease Item I give to the said Mary my Wife for and during the term of her naturall life if she shall so long Continue my Widow the use only of my Brass Copper now standing or being in the Kitchin of my said now dwelling Messuage with free liberty to use the said Copper in the said Kitchin and also the use only of all my household Goods now standing or being in the Hall of my said now dwelling Messuage and from and after her death or Marriage which shall first happen I give the said Copper and all my said Goods in the said Hall to my said son Thomas Ludgater to his own proper use for ever Item I further give to the said Mary my loving Wife to her own proper use all that my bed and bedding with the appurtenances to the same belonging now standing and being in my Parlour of my said now dwelling Messuage ^and all my Leather Chairs standing in my said Parlour and also all and every the Houshold Goods whatsoever which the said Mary my Wife br…ught to me ??? ??? marriage Item I give and bequeath unto my said son Thomas Ludgater To his own proper Use for ever all that my ??? land bedding with the appurtenances to the same belonging now standing and being in the Chamber of my said now dwelling mesuage^ commonly called the best Chamber and all the serge Chairs there and the press of drawers now standing in the said best Chamber Item I give and bequeath unto my Grandaughter Mary Wyatt to her own proper use my silver Tankard and one pair of Holland sheets Item I give and bequeath unto my Grandaughter Etheldred Wyatt my silver Bowle and one pair of Holland sheets Item I give and bequeath unto my Grandson Robert Ludgater the son of my son Robert Ludgater the sum of two pounds Item I give and bequeath unto my said son Thomas Ludgater the sume of twelve pounds this Legacy to my said son Thomas Ludgater to be paid to him within one month next after my decease I also give unto his two Children Thomas Ludgater and Hannah Ludgater to each of them the sume of three pounds to be paid at the time hereinafter limitted for the payment of my other money Legacyes hereinafter bequeathed Item I give and bequeath unto my three Grandsons the three sons of my son Isaac Ludgater as Folows (that is to say) to his son Robert Ludgater my Grandson the sume of five pounds and my silver Cup and to his son Isaac Ludgater my Grandson the sume of five pounds and to his son Levitt Ludgater my Grandson the sume of five pounds Item I give and bequeath unto my two Great Grand daughters Mary Cooke and Susan Cooke to each the sume of three pounds apeice Item I give and bequeath unto my Grand daughter Elizabeth Ludgater and to Sarah Ludgater her sister to each the sume of four pounds apeice and also to each of them one Chest of drawers apeice Item I give and bequeath unto my Great Grandaughter Susan Cooke and to my Grand daughters Elizabeth Ludgater and Sarah Ludgater the sume of forty shillings to be equally divided between them part and share alike in Lien and satisfaction of some goods of their late Mother deceased which were lately sold Item I give and bequeath to the said Mary my loving Wife to her own proper use all my Linen whatsoever not in this my will otherwise bequeathed Item I give unto my said son Thomas Ludgater all my apparell and wearing Cloths whatsoever and one pair of Common sheets and a pair of sheets belonging to the bed in my said best Chamber and also four of my Shirts Item I give unto Elizabeth Cowly my Wifes Kinswoman the sum of thirty shillings Item I give and bequeath unto the said Mary my loving Wife to her own proper use all my pewter and brass and I desire her to give out thereof to my said son Thomas Ludgater one porridge Pott and three pewter dishes of the Middle sort and fower pewter plates Item I give and devise unto my son Isaac Ludgater his Heirs and assignes to his and thier proper use and behoofe Absolutely and for ever all that Messuage or Tenement commonly called the Brewhouse or otherwise with all the out houses buildings Barns stables shedds yards Gardens Orchyards Lands Meadows pastures Ways & waters Water Courses Easements profitts and Hereditaments whatsoever thereunto belonging or reputed to be thereunto belonging with their and every of their appurtenances stituate lying and being in Little Coggshall aforesaid and now or late in the Tenure or Occupation of my said son Isaac or his assignes Item I give and bequeath unto the poor Friends called Quakers belonging unto Coggeshall meeting the sume of forty shillings to be disposed amongst them as my Executrix and Executor shall think fit Item I do hereby declare my Will to be that none of the Legacies in monys herein by me given and bequeathed (other than the said moneys of my said Wife and the said twelve pounds given to my said son Thomas shall be paid untill the moneys which I have at Interest can be gott and paid in and in case my debts and monys shall not be sufficient to pay all my said Legacies in moneys then all and every my said Legatees in monys (Except my said Wife) shall make a proportionable abatement out of their Respective Legacies in moneys and I doo hereby Constitute and appoint the said Mary my loving Wife Executrix and my said son Isaac Ludgater Executor of this my last will and Testament desireing them Faithfully to perform the same in all things according to my true intent and meaning Item I give and bequeath unto my son in Law Thomas Wyatt the sume of three pounds and I desire him to be supervisor of this my Will and Lastly I do hereby give and bequeath unto the said Mary my Wife and to my said son Isaac Ludgater to be equally divided between them part and share alike all the rest and Residue of my Goods Chattells moneys debts and personall Estate whatsoever or wheresoever not herein afore bequeathed after my debts Legacies Funerall charges and probate of this my will first paid and discharged and I doo hereby revoke and make Void all former Wills by me made and I make and Ordain this only to be my last will and Testament in Witness whereof I have to this my last will and Testament contained in seven sheets of paper to every of the said sheets set my hand and seale the day and year first above Written Robert Ludgater signed sealed published and In the Name of God Amen the seaventh day of October in the year of our Lord (one thousand seaven Hundred and fourteen) I Martha Ludgater wife of Robert Ludgater of Little Coggishall in the County of Essex Felmonger In pursuance of a power to me given by the said Robert Ludgater my husband by an Instrument Indenture or other writeing before Marriage with him made from him to Trustees for my vse doe make and ordaine this writeing to be and contain my will purport and meaning and do give & dispose such goods Land & Tenements and monys as hereafter in there presents in expressed to such perlous and in such mannor as hereunder is expressed according to the power to me given contained in the said writeing in primis I give and devise unto my cousin Martha the daughter of John Totteridge of Witham in the County aforesaid ale that house yard and Oarchard logenthe with ale other appurtenance thereunto belonging situated in Witham in the ??? of the said John Totteridge from and after she shall arrive to the age of Twenty One years but in case my said Cousin shale die before she shale arrive to the age of Twenty One years that then I give & devise the said house with its appurtenances unto her Mother Mary Totteridge for & during the ??? of her naturale life and from & after her decease I give & devise the said house with its appurtenan??? unto my Cousin Mary the daughter of the said John Totteridge Item I give & bequeath unto my said Cousin Martha daugher of the said John Totteridge the sume of fifty pound of lawfule mony of Great Brittaine to be payd uto her as soon as she shale arrive to the age of twenty one years or day of mariage which shalle first happen Item I give unto my said husband the sume of tennnd beside which he hath formrly had of me Item I give unto my Cousin Thomas Pery of stebbing in the said County the sume of tenn pound which two last Legacy I will shale be pajd by my Executrix herein after named within six Months next after my decease Item I give unto my Cousin Martha peary the daughter of John peary of Halstead scoolmaster decd the sume of five pound Item I give unto my Cousin Mary daughter of the said John peary the sume of five pound Item I give unto My Cousin John Peary son of the said John peary the sume of five pound Item I give unto my Cousin Thomas peary the son of the said Thomas peary the sume of five pound Item I give unto my Cousin Hannah peary daughter of the said Thomas peary the sume of five pounds which said five last menconed Legacys I will shall be payd by my said Eecutrix as soon as they shale arrive to their respective ages of Twenty One yeares or their respective dayes of Marriage Item I give unto my Cousin Martha Totteridge ale the houshold Goods I formerly gave her and my appar???
