ON the Twenty eighth day of January 1871 the Will of James Relf the Elder late of Heathfield in the County of Sussex Farmer deceased, who died on the seventh day of January 1871 at Heathfield aforesaid was proved in the District Registry attached to Her Majesty's Court of Probate at Lewes by the Oath of James Relf of Burwash in the said County Beer Retailer and David Relf of Heathfield aforesaid Farmer the Sons of the said Deceased the Executors therein named they having been first sworn duly to administer. This is the last Will and Testament of me James Relf the elder of Heathfield in the County of Sussex Farmer I appoint my sons James Relf and David Relf joint Executors of this my Will I authorize empower and direct my Executors or Executor Administrators or Administrator for the time being of this my Will to sell and dispose of all my Copyhold Messuages Lands Tenements and Hereditaments whatsoever and wheresoever either by public Auction or private Contract according to their or his discretion And I also direct that the monies to arise from Sale of my said Copyhold Hereditaments shall be paid to and received by my said Executors or Executor Administrators or Administrator for the time being and shall be paid or applied by them or him in aid and as part of my Personal Estate And that their or his receipt or receipts for the said purchase monies shall be sufficient discharge or discharges to the purchaser or purchasers for his her or their purchase money and such purchaser or purchasers shall not afterwards be answerable or accountable for the application of the said purchase monies or any part thereof And as touching my said Personal Estate and the Monies to arise by Sale as aforesaid I dispose thereof as follows I direct that all my just Debts Funeral Testamentary and other Expences shall be paid and discharged as soon as conveniently can be after my death by my said Executors And I give and bequeath All the Rest Residue and Remainder of my said Personal Estate and Monies aforesaid unto my Sons and Daughters, namely, the said James Relf and David Relf and Richard Relf and Sophia the late Wife of Richard Thomson deceased Keziah Wife of Joseph Luck and Susan Wife of Edward Barden equally to be divided between them share and share alike to their several and respective use and uses And I direct that the respective Shares of my said Daughters Keziah Luck and Susan Barden shall be paid into the sole and separate hands of them my said Daughters respectively independent of their respective Husbands and that their respective receipts for the same notwithstanding coverture shall be good discharges for the same Shares respectively And I declare that any sum or sums of money by me advanced or paid to or for the benefit of either or any of my said Sons or Daughters or the Husband or Husbands of either or any of my said Daughters and for which he she or they shall have given me security or acknowledgement or of which I shall have kept any account with the interest thereon and whether or not such security acknowledgement or account shall be within the date or time fixed or allowed by the Statute for the limitation of actions shall be taken and considered as part and on account of the Share or Shares of my said Sons or Daughters respectively and shall be accounted for accordingly And I also declare that in case either or any of the said several Residuary Legatees shall happen to die in my lifetime, or before their respective shares shall be actually paid, and leave lawful Issue the part or share or parts or shares of him her or them so dying shall be paid to his her or their respective Issue if more than one Child equally between them And I also declare that my said Executors shall be chargeable respectively for such monies only as they shall actually receive or shall come to their respective hands by virtue of this my Will and not for each other or for involuntary losses And that they may deduct and retain out of the monies coming to their hands by virtue of this my Will all Costs Charges Losses Damagers and Expences which they shall or may reasonably incur or sustain in the execution and performance of this my Will with a fair allowance for their time and trouble therein And lastly I hereby revoke all former Wills whatsoever In Witness whereof I the said James Relf the testator have hereunto set my hand the tenth day of February in the year of our Lord one thousand eight hundred and sixty nine James Relf Sener Signed by the said James Relf the testator and by him acknowledged and declared as and for his last Will and Testament in the presence of us present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as attesting Witnesses Wallu Sprott Sopr Mayfield Benj Buss Mayfield Proved at Lewes the 28th day of January 1871 by the Oath of James Relf and David Relf the Sons the Executors to whom administration was granted The Testator James Relf the Elder was late of Heathfield in the County of Sussex Farmer and died on the 7th day of January 1871 at Heathfield aforesaid Under £600 W.
