This is the last Will and Testament of me Rose Fuller of Hunters Farm in the Parish of Brightling in the County of Sussex Farmer made this twenty second day of March one thousand eight hundred and fifty nine I direct my just debts funeral testamentary and incidental expences to be first paid I give devise and bequeath direct and appoint unto my dear Wife Priscilla Fuller and my two sons Thomas Fuller and James Fuller and their heirs All and every of my messuages or tenements cottages buildings lands hereditaments and real Estate whatsoever and wheresoever in Brightling aforesaid or elsewhere To hold the same hereditaments and real Estate unto them my said Wife Priscilla Fuller and my said sons Thomas Fuller and James Fuller and their heirs Upon and for the several trusts intents and purposes hereinafter mentioned that is to say Upon trust that they my said Wife Priscilla Fuller and my said sons Thomas Fuller and James Fuller or the survivors or survivor of them or the heirs of such survi??? do and shall as soon as conveniently may be after my decease sell and absolutely dispose of my said messuages or tenements cottages buildings lands hereditaments and real Estate for the most money that can reasonably be obtained for the same either by public auction or by private Contract and either together or separately and either subject or not subject to any conditions as to title or otherwise and with full power to ??? in at any Auction or vary or rescind any contract for sale and again to resell the same without being liable for any loss that may arise thereby And upon further trust to convey surrender or assure the hereditaments and real Estate so sold to the purchaser or purchasers thereof and his her or their heirs and assigns ^or^ as he she or they may direct and to give one or more receipt or receipts for the purchase monies to arise from the sale thereof which receipt or receipts shall be good and sufficient discharge or discharges for the sums therein expressed to be received and the purchaser or purchasers paying such monies shall not after such receipts Given be obliged to see to the application or be answerable or accountable for any loss misapplication or nonapplication of such purchase moneys or any part thereof And I direct that my said Wife Priscilla Fuller and my said sons Thomas Fuller and James Fuller or the survivors or survivor of them or the heirs of such survivor do and shall stand possessed of the net monies to arise from the sale of my said hereditaments and real Estate after payment of the principal and interest monies due on mortgage thereof and also costs charges and expences relating thereto or attending the sale or sales aforesaid or otherwise Upon the trusts and for the purposes hereinafter mentioned Also I give and bequeath unto my said Wife Priscilla Fuller and my said Sons Thomas Fuller and James Fuller their executors and administrators All my monies securities for money live and dead farming stock goods chattels inventory and effects on Hunters farm aforesaid and also other my personal Estate whatsoever and wheresoever Upon trust that they my said Wife Priscilla Fuller and my said Sons Thomas Fuller and James Fuller or the survivors or survivor of them or the executors or administrators of such survivor do and shall use and employ my said monies stock goods chattels inventory effects and personal Estate in carrying on and doing all necessary acts for carrying on the Business of the said Farm called Hunters from the time of my decease until they my said trustees can legally quit the possession and occupation of such Farm and which I desire them to do as soon as the law will allow And upon further trust to collect get in sell dispose of convert into money and receive my said monies securities stock goods chattels inventory effects and personal Estate and to stand possessed of all the net monies to arise and be received therefrom and from carrying on my said farming business Upon trust after paying my said just debts funeral testamentary and incidental expences and otherwise Upon trusts and for the purposes hereinafter mentioned that is to say Upon trust to invest the whole of the net monies arising from my said real and personal Estates upon real or government securities at interest and to vary (?) call in and reinvest the same or any part thereof upon like securities and to pay or otherwise permit my said Wife Priscilla Fuller to retain for her own use and benefit the interest dividends and annual proceeds to arise and be received from the monies so to be invested as aforesaid for and during the term of her natural life And from and immediately after her death to pay and divide the whole of the net monies arising from my said real and personal Estates in equal eleventh parts unto and between such of my children as shall be then living and the issue then living of such of my children as shall be then dead so as that each of my children then living shall receive one eleventh share and the issue of such deceased child shall receive one eleventh share Provided and I do hereby will and direct that in case either or any of my children shall have died either in my lifetime or in the lifetime of my said Wife Priscilla Fuller without leaving issue then living that then and in such case the share or shares of him her or them so dying without issue then living shall go to the survivors or survivor of my said children and the issue of any deceased child or children per capita and per stirpes Provided also and I will and direct that until the sale of my said hereditaments and real Estate the same shall be demised and let at the best rent that can reasonably be obtained for the same in such way as the trustee or trustees for the time being of this my Will shall think most advantageous and after payment out of such rent of the interest on the mortgage debt thereon and the necessary expences of repairs and insurance the net rent so to arise from my said hereditaments and real Estate shall go and be paid and applied in the same manner as the interest and dividends on the net monies to arise from the sale thereof would have gone and have been payable in case the same had been sold and disposed of under the trust aforesaid And I exempt every trustee of this my Will from liability for losses occurring without her or his own wilful default and authorize her and him to retain and to allow to her or his ??? trustee or trustees any expences incidental to the trusteeship with a reasonable allowance for her and his journies trouble and loss of time And I nominate constitute and appoint my said Wife Priscilla Fuller and my said sons Thomas Fuller and James Fuller joint Executors and trustees of this my Will And lastly I revoke all former Wills and Codicils by me made In witness whereof I have to this my last Will and Testament contained in this and the two preceding sheets of paper signed my name the day and year first above written The mark of + Rose Fuller The before written last Will and Testament of the above named Rose Fuller the testator contained in this and the two preceding sheets of paper was signed by him in the presence of us witnesses present at the same time and we attest and subscribe our names hereto in his presence and in the presence of each other and we certify that before the said Will was signed by the said Rose Fuller the same was read over to him and that he appeared fully to understand the same John B Hayley Edwin Church Proved at Lewes the 18 ?? day of February 1867 by the oaths of Thomas Fuller and James Fuller the Sons the surviving Executors to whom administration was granted The Testator Rose Fuller was late of Hunter's Farm in the Parish of Brightling in the County of Sussex Farmer and died on the eighteenth day of January 1867 at Hunter's Farm aforesaid Under £200 J.
